I know from working in surgery that this does happen, but I've never heard any anesthesiologist or CRNA act this way and say such awful things.
Most malpractice covers defamation, but they usually do not cover punitive damages. They would have to be paid out by the physician.
I know that we all say silly things that we probably shouldn't say when we are in surgery and the patient is asleep. But always be mindful of the patient. If you ever do hear anything like this, remember as the patient's advocate, you need to stop it in its tracks. Even if it means reporting the physician and asking them to please not speak that way in the presence of your patients.
